Procedures

Compared to many European countries, the procedure of buying/selling real estate is quite simple in Turkey. The transfer of the property is only made by the Land Registry Office of the relevant district.

The costs of Buying a property;

1. Sales transaction tax: 4% on the 'declared' value of the property to be paid to the government (e.g.: if declaration of buying price is 30.000€ than the fee is 1200.-€)
2. Application fee: 320.-€ (a service value is paid to provide the necessary information and paperwork for the application to the Military such as maps, passport translations,etc)
3. Translator fee: 100.-€ (it is necessary to have a translator at the stage of Tapu transfer to make sure that the Buyer has accepted the context) P.S.: For english speakers, our agency is providing this service free of charge as having an authorised translator in the team.
4. Real Estate Agenct Fee: Registered and licenced real estate agents are entitled to receive 3% + VAT service fee over the actual sales price of the property from each party.
In case the pre-sales agreement is asked to be notarised, then approximately 1% of the actual selling price of the property has to be paid by the buyer to the Notary Public.
Additional Costs: The transactions carried out after the 'Tapu' the title deed is transferred to the name of the buyer:
Electricity register transfer for the house : Approximately 100 ~ 200.-€
Water register transfer for the house : Approximately 75 ~ 200.-€
Satellite membership for TV- Digiturk : Approximately 100.-€
Telephone line : Approximately 10.-€( it is compulsory to have a residence permit to get a line) Property municipal tax : Paid on yearly basis based on approximately 0.1% of the annual evaluation of the property


HOW IS THE BUYING PROCEDURE ?
Agreement
Once you have decided on a property from our portfolio we will assist you with the following agreement procedures: Legal checks of the property to allow a clear transaction Organising a valid contract in line with the Turkish Ownership laws for the sales of the property that protects the Buyers rights Organising standard official deposit agreement to secure both parties. Finding a solicitor approved by the referring Embassy should the Buyer request a solicitor Start and follow-up all the applications (authorisation from the Army Headquarters and Cadastral checks and approvals) until the stage of title deed delivery. Getting residence permits from the Foreigners Police Department (due to reciprocal agreements, for some nationals it is cumpolsory to get residence permit of minimum 6 months)
Deposit Payment Before we start the procedures at the Land Registry Office, a deposit of 20% of the sales price will be asked to be paid to the Seller (as outlined in the contract). The payment of the remaining sum i.e.80%, shall be paid when all the legal procedures are finalised and parties are called for transaction.
Permission In case the buyer is a foreign national, it is required to have a written authorisation by the Eagian Army Headquarters. This a procedure that is necessary to check that the property is not within the military forbidden and strategic zones and again with this respect check the identifications of the prospect Buyers.
Deed Delivery –'Tapu' Once we receive the approval for the transfer of the deed, called 'TAPU' to your name, you have either the option to give a representator of Second Home Turkey or your solicitor a power of attorney to register the property on your name or to come once again on call for the termination of the documents.
At this stage the costs No:1-5 stated in 'General Buying/Selling Procedures'are asked to be covered.
